A BILL to amend article five, chapter forty-four-a of the code
of West Virginia, one thousand nine hundred thirty-one, as
amended, by adding thereto a new section, designated section
nine, relating to standby guardianship; and providing that
the documents contained in the court file be confidential.
Be it enacted by the Legislature of West Virginia:
That article five, chapter forty-four-a of the code of West
Virginia, one thousand nine hundred thirty-one, as amended, be
amended by adding thereto a new section, designated section nine,
to read as follows:
ARTICLE 5. STANDBY GUARDIANSHIP.
§44A-5-9. Petition and other records pertaining to standby
guardianship confidential.
Upon the filing of a petition requesting the approval of a
standby guardian, all pleadings, exhibits and other documents
contained in the court file are considered confidential and not open for public inspection, either during the pendency of the
case or after the case is closed. The contents of the court file
are open to inspection and copying by the parties, their
designees and their attorneys.
This section is new; therefore, strike-throughs and
underlining are omitted.
